The US Supreme Court will not review the scope of Double Jeopardy Right

The United States Supreme Court will not consider whether the constitutional prohibition in double danger prohibits prosecutors to reject murder positions decades after a null trial.

The judges refused on Monday to take John Kevin Woodward’s appeal, who was tested twice by the 1992 murder of his room’s girlfriend, Laurie Houts. Both jurors blocked in the point of condemning Woodward and a judge dismissed the charges in 1996.

Prosecutors recharged Woodward in 2022, citing advances in DNA technology.

Woodward argues that the new positions violate the prohibition of the fifth amendment on the double danger, which prohibits the prosecutions by substantially the same crime.
