Prosecutors reveal new details in the death of Jimmie ‘Jay’ Lee; Tim Herrington denied bond

Lafayette County, Miss. (WLBT) – Bond was denied by Timothy Herrington.

That is the ruling of the Lafayette County Circuit Court, Kelly Luther, delivered during a bail hearing for Sheldon Timothy Herrington Jr. on Thursday.

The State also expressed that it would not seek the death penalty in this case of capital murder.

Herrington is accused of killing his classmate Jimmie “Jay” Lee in July 2022.

The Granada County man is being accused of capital murder and evidence manipulation.

The prosecutors claim that Herrington and Lee were in a sexual relationship, and argued that Herrington killed Lee because he did not want to be expelled as gay.

Lee’s body was found earlier this month in Carroll County.

The Prosecutor’s Office believes that this discovery paints a clearer image of Herrington that is behind the murder.

“Jay Lee disappeared, he had a hood and a robe,” said Gwen Agho, who is a specialized prosecutor for this case. “The facts and evidence in this case are that Timothy Herrington has a moving truck, and we saw that all moral Last time leaving his house to go to Timothy Herrington’s house, and with a moving blanket and adhesive tape that we know that Mr. Herrington went and bought. “

These new details were a surprise for defense.

“That was the first time I heard that today, and that was another issue that we raised,” said Aafram Sellers, who now represents Herrington. “We hadn’t received that information, so the first time I heard that was today.”

When this case was for the first time to trial in December, it ended with a jury hanging.

Of the 12 jurors, Once thought Herrington was guilty, and a person thought otherwise.

The reasoning of the solitary jury is that at that time, Lee’s body was not found.

Lee’s body was discovered by two deer hunters.

The Oxford Police Department and the Carroll County Sheriff’s Office, together with the Mississippi state crime laboratory, confirmed through the DNA analysis that the remains belonged to Lee.

Weeks after this discovery, Herrington was restructured and was given the new evidence manipulation position.

Sellers is asking that this position be dismissed, claiming that it is prohibited by the Mississippi limitations statute, which means that the time limit has passed to load Herrington with that position.

“If they were going to bring the position, they should have been brought first,” Sellers said

With the body now discovered, Sellers says that it is still determining what your defense strategy will be for this case.

“I have not seen any of the tests,” Sellers said. “Most of the evidence I have seen has been what I saw in motion today. My determination in defense has not yet been done. I am in a unique position to be able to put a new set of eyes throughout the evidence. I have not formed an opinion on how that changes anything. My client is presumed innocent and maintains his innocence.”

Herrington will now remain behind bars in Lafayette County prison until his new trial.

The new trial will begin on October 13 in Lafayette County.

The jury selection is scheduled to start at 9 am
