SC Compensation Orders for workers affected by Brap Bords: No Orders are needed

The Supreme Court has directed Haryana, Uttar Pradesh and Rajasthan to compensate for construction workers affected by the suspension of work due to the measures of the Gradada Response Action Plan (Grap) in Delhi-DNCR, even in the absence of a specific judicial order.

A bank that includes Judges Abhay S Oka and Ujjal Buyan ruled that compensation must be provided using funds collected through labor cessation.

“With regard to 2024 and 2025, we have issued instructions to the states to pay compensation. From now on, every time construction activities are stopped due to the implementation of GRAP, the affected workers must be compensated according to November 24, November 24, November 20, 2021”. During Friday’s hearing, the Court was informed that Haryana had compensated at 2,68,759 and 2,24,881 workers during the first and second phases of GRAP-4, respectively. In addition, the process of paying compensation to approximately 95,000 workers for the January 2025 period is in progress.

Delhi’s lawyer informed the Court that 93,272 workers had received compensation, while the verification process for the remaining registered workers was underway. Rajasthan reported having paid compensation to 3,197 workers, while Uttar Pradesh disbursed funds at 4,88,246, 4,84,157 and 691 workers in different stages of GRAP.

Previously, the Court had criticized the Delhi government for not fully providing subsistence subsistence to construction workers affected by labor -related work strikes. He ordered the Delhi government to immediately convene a meeting with workers’ unions to guarantee the appropriate registration.

Similar orders were issued for Rajasthan, who has two districts of NCR (Bharatpur and Alwar), along with 14 districts in Haryana and eight in Uttar Pradesh, instructing them to hold meetings with workers’ unions and guarantee subsistence subsidies.

On December 2, the Supreme Court summoned the main secretaries of the NCR states through videoconferences to confirm whether compensation to the workers affected by the restrictions had been provided.
