Consider frameting the laws to ensure the rights of domestic workers: the court superior to the center

The Supreme Court requested on Wednesday to the central government to consider the need to introduce a legal framework to effectively address the concerns and rights of domestic workers.

The Superior Court declared that the Government could consider approveing ​​the law after the committee, ordered to be constituted by the Court today, presented its report.

For the protection of domestic workers, the Court has addressed the Ministry of Labor and Employment, in coordination with the Ministry of Justice and Social Empowerment, the Ministry of Development of Women and Children, and the Ministry of Law and Justice, to jointly constitute a committee.

The committee, which includes experts in subjects, will evaluate the convenience of recommending a legal framework for the benefit, protection and regulation of domestic workers.

The composition of the expert committee has been left at the discretion of the government of India and its worried ministries.

A bank led by Judge Surya Kant declared that it would be appreciated if the Committee presented its report within six months.

The instructions came when listening to a case in which the accusations of Exploitation of a domestic worker Under the pretext of ensuring their employment they were raised.

The court observed that, given the lack of specific protection for domestic workers in India, it became the duty and responsibility of the court to intervene, exercise the doctrine of the Patriae parents and forge a path to their well -being.

By pointing out that there are gaps in the legislative frameworks that safeguard the rights of domestic workers, the court emphasized that so far no legislative or executive measures have been carried out to promulgate a statute that could benefit millions of vulnerable domestic workers throughout the country .

In addition, domestic workers remain largely excluded from existing labor laws.

“It is in this sense that once again we rest our faith in the legislature and the elected representatives of the Indian people to take the necessary steps to guarantee justice for domestic workers. In light of the same, we eliminate these appeals with specific addresses to the government of India, ”the Superior Court observed.
