The trial for stabbing murder of the death of Seb O’Halloran begins, since the defendant lawyers of the defendants claim self -defense

A teenager was acting in self -defense when he stabbed a man in Mildura in October 2023, according to a court.

Seb O’Halloran died of a white weapon wounds in a milled house rented by the defendant and his then partner in the early hours of October 21, prosecutors told the Supreme Court.

Defensor lawyer Sharon Lacy SC told the court that her client did what was necessary at the time and had believed that Mr. O’Halloran was a dangerous individual.

“He had reasons to fear both (his former partner and Mr. O’Halloran),” Lacy said.

Both the defendant, now 18, and his former partner cannot be appointed for legal reasons.

The teenager was accused of a murder position for the incident, and declared himself innocent on Monday.

Crown argues accused “destined to kill”

On Monday, the Supreme Court listened to opening arguments of the Department of Public Procedure and Defensor Lawyers.

Prosecutor Jordan Johnston argued that after a series of altercations, the defendant took a kitchen knife to his former partner, before Mr. O’Halloran got out of the couple.

“The case of the crown is that when (the defendant) stabbed Seb, he intended to kill,”

said.

“The crown will say that this was a violent act.”

The prosecutors said before the alleged murder that the adolescent cut the tires of his former partner with a knife and cut his clothes with scissors.

Johnston said the defendant also threw a blow to his former partner who “left a hole” on the wall.

The defending lawyer Sharon Lacy urged the jury to consider the relations between the three adolescents as a “central characteristic” of the trial and destiny of the accused.

Lacy also told the jury to consider two problems in dispute at the trial.

First, if the defendant intended to kill or seriously hurt Seb O’Halloran and, secondly, if he was acting in self -defense.

A 12 -year jury was also empanized for trial on Monday morning.

The Judge of the Supreme Court, Rita Inrti, told the jury that they would travel to Mildura on Tuesday to examine the evidence in the crime scene.

The trial continues tomorrow.
