Shariah court in Indonesia sentences 2 men to up to 85 tabs for having gay sex

Banda Aceh, Indonesia – an Islamic Court of Shariah in the conservative province of Aceh in Indonesia on Monday sentenced two men to the public stab for having gay sex.

The couple, 24 and 18, was arrested on November 7, after the vigilantes of the neighborhood in the provincial capital, Banda Aceh, suspected that being gay and broke into their rented room to catch them naked and hugging.

The main judge said that the two university students were “legally and convincingly” demonstrated that they had gay sex and that they would receive 85 and 80 blows respectively.

“During the trial it was shown that the defendants committed illegal acts, including kissing and having sex.” The judge said, Sakwanah, who takes a single name like many Indonesians. “As Muslims, the defendants must defend the law of the Shariah that prevails in Aceh,” he added.

She said the three judges panel decided not to impose the maximum sentence of 100 tabs because men were outstanding students who were educated in court, cooperated with the authorities and had no previous convictions.

Prosecutors previously demanded that each one obtained 80 blows, but the judges decided a harder punishment for the older man because they believed that he was the one who had encouraged and provided a place for sexual relations.

Both prosecutors and lawyers of the two men said they accepted the sentence and that they did not appeal.

Aceh is considered more devoted than other areas of the Muslim majority of Indonesia and is the only province that is allowed to observe a version of the Islamic law of the Shariah.

The Secular Central Government of Indonesia granted Aceh the right to implement the Shariah Islamic Law in 2006 as part of a peace agreement to end a separatist war. A religious police and a judicial system have been established, and the new law is a significant strengthening of Shariah in the region. Every year since then, more than 100 people have been publicly placed.

Aceh implemented an expansion of the Islamic statutes and the Criminal Code in 2015 that extended the Shariah law to the non -Muslim persons of the province, which represent approximately 1% of the population, and allows up to 100 tabs for crimes of morality, including the gay sex and sex between. This will be the third time that Aceh has people for homosexuality.

Human rights groups have criticized the law, saying that it violates international treaties signed by Indonesia that protect the rights of minorities.

The National Criminal Code of Indonesia does not regulate homosexuality, and the central government does not have the power to demolish the Shariah law in Aceh. However, an earlier version of the law that required people to be stoned to death by adultery was eliminated due to the pressure of the central government.
