SC will not intervene in Madras HCraga Cancellation Notice of the ISHA Foundation

The Supreme Court refused on Friday to intervene in the ruling of December 14, 2022 of Madras, annulling the notice of the exhibition cause issued to the ISHA Foundation with respect to the construction of its Yoga and Meditation Center. The court also dismissed an appeal filed by the Tamil Nadu (TNPCB) contamination board that challenges the HC ruling.

The bank, which includes Judges Surya Kant and NK Singh, declared: “In our opinion, there is no case to interfere with the judgment of the Superior Court, particularly in relation to the existing structure of the Yoga and Meditation Center established by the Isha Yoga Foundation. Therefore, coercive measures against the base will not be taken regarding the construction of the building. “

The Court clarified that its ruling, as well as that of the Superior Court, is based on the specific facts of this case and should not be considered a precedent to legitimize illegal or unauthorized constructions in the future.

The TNPCB had requested the court to allow an inspection of the facilities by the City Planning Directorate and the country to evaluate the scope of the construction carried out. The general lawyer PS Raman, which represents the TNPCB, declared: “If the construction falls within the approved limits, we will not have objection.”

In response, the lawyer Senior Mukul Rohatgi, who represents the Foundation, opposed this request, arguing that he would initiate another round of action against the Foundation.

The court also pointed out in its order: “It is not necessary to say that if there is any need for future expansion, the Foundation must seek the prior approval of the competent authority.”

During the previous hearing of February 14, 2024, the Supreme Court expressed concern about the delay of more than two years in the presentation of the appeal, and commented: “When the State addresses us with the task, it raises suspicions.”
