Gardner’s lawyers are looking for sanctions for SAO, they say “he abused his authority” in case of contract murder

Jacksonville, Florida. -The lawyers from Shanna Gardner, accused of conspiring so that her ex -husband dies in 2022, presented a new motion on Thursday to sanction prosecutors with the state prosecutor’s office, after the discovery of several “violations and failures” in the case.

José Baez, Gardner’s lawyer, presented the new motion that includes 12 arguments to support her, and said that “the state prosecutor’s office has been repeatedly and without an abused consequence of his authority.”

The motion also stated that the prosecutor issued an “ex-party investigation citation” in June 2024 to JB, who was identified as an “alleged co-conspirator not accused” in the case. According to the motion, the use of the citation by the prosecutor was “illegal” because Gardner listed JB as a defense witness in December 2023.

“Em. Gardner has been harmed because he has no idea what information JB provided to prosecutors,” says the motion.

Gardner and her separate husband Mario Fernández are under accusation for first -degree murder in what prosecutors say it was a rental assault plot in the death of Gardner’s ex -husband, 33 years Jared Bridegan.

The new motion also mentions Henry Tenon, the man who admitted to having pressed the trigger in the murder of Bridegan, And who recently retreated in his affidavit That incriminated Gardner and Fernández.

According to the motion, the state prosecutor’s office “did not reveal favorable evidence” in a timely manner, claiming that the prosecutor “buried” the claims of “false testimony” of tenon with other materials. The motion then adds that the transcription of the Tenon audience was completed on January 21 and the defense was able to access the transcription on February 5 and that it was not “without more than 80 files.”

The motion also establishes that the state prosecutor’s office used “hard hand tactics” with a defense witness identified as KJ

Gardner’s lawyer said that KJ was intimidated by the agents of the law that served him a citation in a Publix supermarket parking lot so that “immediately” appeared in the state prosecutor’s office in July 2023 and was “threatened with arrest for murder” by the prosecutor.

“The State has not revealed reports, notes or other documentation that commemorates this meeting,” says the motion.

According to the motion, Gardner is looking for the following sanctions and relief:

  • Prohibit the State (prosecutors and application of the law) to obtain any search warrants or issue any appointment in this case without first notifying Mrs. Gardner.

  • Order the State (prosecutors and forces of the order) to deliver each and every one of the notes related to the ex -part meetings with Tenon, KJ and JB in the State Prosecutor’s Office.

  • Prohibit the State (prosecutors and application of the law) having any ex -part with an Tenon without first providing a notice to the defendants and the opportunity to be present.

  • Authorize Mrs. Gardner to depose Alan Chipperfield and Matthew Bodie, Tenon lawyers, regarding meetings in the state prosecutor’s office between Tenon and prosecutors.

  • Order to the State Prosecutor’s Office to pay the costs of Mrs. Gardner associated with the litigation of this and any additional discovery problem in this case at a rate of $ 500 per hour.

Tenon, who declared himself guilty of second -degree murder for death to Bridegan’s shots, had stopped in the Duval County prison since his arrest in January 2023. But, according to the prisoner of the Office of the Sheriff of the County of Nassau, he transferred to his jail on Wednesday.

Gardner and Fernández face the possible death penalty and are currently detained without bail.
