Who is responsible for the disappearance of Tara Grinstead? The court throws pending charges

In an important legal decision, a Georgia Court of Appeals dismissed pending charges against two men convicted for hiding the death of Tara Grinstead, a high school teacher whose 2005 disappearance remained a mystery for more than a decade. The court ruled that prosecutors waited too much to present positions, allowing the statute of limitations to expire.

What ruled the Court?

The Georgia Court of Appeals determined that the Police had a probable cause to arrest Ryan Duke and Bo Dukes already in November 2005. It was then that a witness told the police at a party that men had admitted to having killed Grinstead and burn their body in a nut garden. Despite this Council, the Police did not arrest until 2017.

According to Georgia’s law, prosecutors had four years since they had a probable cause to press charges. While the authorities argued that the timeline began in 2017, when men confessed, the Court did not agree, ruling that the clock had begun in 2005. As a result, the charges in Ben Hill County considered themselves too late.

Who was grinstead?

Grinstead, a 30 -year -old beauty queen and a secondary school teacher, was last seen in Vocilla, Georgia, in October 2005. Despite the extensive searches, his body never recovered completely. His face rose in an advertising fence in search of advice in his disappearance until arrests were made in February 2017.

The researchers found bone fragments in the nut forest, where Duke said they burned their remains, but DNA tests were not conclusive.

What happened to Duke and Dukes?

The dismissal only applies to the newer positions. Both men continue to comply with prison sentences:

  • Ryan Duke was sentenced in 2022 for hiding Grinstead’s death but acquitted of murder. He is serving a 10 -year sentence.
  • Bo Dukes was convicted in 2019 for his role in the crime part and lying to the police. He is doing 25 years in prison.
