The NDIS Livebetter provider faces criminal charges for the mortal water burns of the woman’s bathroom

Criminal charges have been submitted against a supplier of disability services of Nueva Wales del Sur for the death of an indigenous woman who suffered burns up to 40 percent of her body during a bathroom.

Kyah Lucas, 28, died at the Concord repatriation hospital in February 2022 due to injuries he suffered at home in the center of the state.

Safework NSW has presented charges against the national provider of Livebetter disability insurance under the Labor Health and Safety Law (WHS).

The provider was accused of breach of his duty of care under the legislation.

It is the highest category of rape that involves a company that through serious negligence or reckless behavior is accused of exposing others to a significant risk of death or serious injuries.

Livebetter has also been accused of not immediately notifying the regulator of a notifiable incident.

Mrs. Lucas had been a Livebetter client since at least 2009.

She was not verbal and had multiple disabilities and health conditions that made her body regulate her temperature.

Mrs. Lucas suffered severe burns after receiving Livebetter bath support services at her home in Orange.

He died at the hospital five days later as a result of his wounds.

Livebetter declined to comment on the procedures, but said in a statement to ABC that the service continued to cry the tragic death of Mrs. Lucas.

The case will return to the NSW district court in April.
