Summary:

  • The Federal Court has approved a release date for the first period of claims to begin for those affected by discrimination in the Children’s and Family Services Program of the first nations and the limited application of the Jordan’s main collective action agreement.
  • This process is separate and different from continuous efforts to ensure an agreement on the long -term reform of the children’s and family services of the first nations. The negotiations on compensation and long -term reform are two different agreements with different approval processes.

On December 12, 2024, the Federal Court of Canada issued a decision letter regarding the agreement for the conciliation of collective actions for the people of the first nations affected by discrimination in the Children and Family Services Program of the first nations ( FNCFS) and a limited application of the Jordan principle. The decision letter approved the opening of the first period of claims to begin on March 10, 2025.

Long -term reform distinction

The final compensation conciliation agreement is a separate agreement of the ongoing efforts to ensure an agreement on long -term reform. The Final Conciliation Agreement on Compensation was presented to the first nations in the assembly for support in April 2023. On April 4, 2023, the first nation in the assembly unanimously approved the FSA through resolution 04/2023 Revised on compensation for children and families of the first nations.

The draft agreement on the long -term reform was presented to leadership in October 2024 and was not ratified by the first nations in assembly at that time. According to the 60/2024 resolutions, addressing the long -term reform of the children’s and family services program of the first nations and the principle of Jordan, and 61/2024, significant consultation on the long -term reform of children’s services and Relatives of the first nations, the efforts to negotiate and ensure a new agreement on long -term reform are now under the scope of the National Chiefs of Children.

Eligibility and application

This period of claims will apply to the child eliminated and eliminated family class for children. These first two classes include people from the first nations who were withdrawn from their homes as children between April 1, 1991 and March 31, 2022, while living in reserve or in the Yukón and were put in care funded by the indigenous services, as well as their care parents or care.

When the claims period open, it eliminated the members of the family class and eliminated the children, they will be able to present their claim form to the administrator. While compensation is not yet available, there are steps that class members can now take to prepare for the claims period ensuring that they have a valid identification issued by the Government and a postal address. Class members must also have access to a bank in their name so that the administrator can deposit compensation directly in his account.

Class members are three years old to file their claim once they have reached the age of majority. Those who are currently minor may file a claim up to two years before reaching the age of majority. If a class member cannot request within three years due to mitigating circumstances, you can request an extension of up to one year. This would be subject to approval.

Compensation distribution

Compensation can only be distributed to eligible plaintiffs once they reach the age of majority, even if they apply as minors. The amount of compensation for each claimant will vary by the class in which they apply and the circumstances of the application. Payments may vary from $ 20,000 to $ 40,000 per individual. Some claimants may be eligible for additional compensation.

Some class members can be eligible for more than one class. Note that a separate claim form must be sent for each class.

Additional classes under the agreement

The family classes of children eliminated are two kinds of nine covered by the final compensation settlement agreement. The period of claims that open on March 10, 2025 only applies to these two classes. The periods of claim for the seven additional classes will be opened at a later date, since each distribution protocol must be approved by the Federal Court.

Fraud, support and resources

You do not need to pay anyone to help you file a claim or help you receive payment. Keep in mind that fraudulent legal representatives can try to exploit the requests of the first nations under the claims process. No one should request personal information. The administrator is not reaching the class members. If anyone who claims to be with this agreement and request information, communicate with the administrator at 1-833-852-0755 or [email protected]. Informing an incident will help protect class members and can prevent someone from becoming a victim of fraud.

The aid is available for people who prepare to request the claims process from March 10, 2025. Class members who have questions or need support with their claim can communicate with the administrator’s contact center that can connect them to a claims assistant if necessary. Claims assistants can provide informed support for individual trauma to complete the online claim form, by phone or in person, when available. Claims assistants can also help class members connect to local services and well -being.
