Air Canada demands the passenger who spent thousands of clothes while missing his luggage, so who is on the right?

These purchases do not fly under the radar.

When Alaa Tannous and his wife Nancy flew with Air Canada in 2022, the airline lost its controlled luggage.

According The streetThe luggage was returned to Toronto’s couple less than 24 hours later, but Tannous sought compensation for the purchases he made while missing the luggage, totaling thousands of dollars.

Air Canada appealed the decision of the regulators to pay the couple for the expenses incurred as a result of delayed luggage. Reuters

Although Air Canada Rejected Tannous’s claim, the Canadian transport agency ordered the airline to pay Tannous $ 2,079 CDN ($ 1,440 USD).

However, Air Canada is now demanding Tannous, taking him to the Federal Court in an attempt to cancel the decision of the CTA.

“It was shocking,” said Tannous CBCHe added that he felt his question was “fair.”

“It is disappointing to see the airline, after all the money I spent over the years (it is …) appealing a claim of $ 2,000.”

Initially, Tannous requested $ 3,435 CDN (approximately $ 2,382 USD) of the airline, which he rejected and, on the other hand, offered $ 250 scarce in compensation to cover the necessary costs, a solution that did not satisfy Tannous.

In judicial documents obtained by CBC, Air Canada affirmed that Tannous presented expenses that the airline considered unreasonable for lacking luggage for less than a day.

A statement From Air Canada, published to LinkedIn, he said that Tannous’s luggage was delivered to the Vancouver hotel on May 26, 2022 at 9:15 am local time, less than 24 hours after travelers landed in the city.

In the statement, the airline said that Tannous spent $ 570.12 CDN on dressing articles, skin care and makeup; $ 1.121.86 CDN for two pairs of pants, three shirts and a single dress that costs $ 348.84 CDN; $ 247.52 CDN in four sets of lingerie and sleep clothing; and $ 525.50 CDN for underwear, jeans and two shirts.

After the bags were delivered, Air Canada said that Tannous spent and tried to spend $ 433.61 on women’s sneakers and $ 1,310.40 for a personalized monogrammed tumi suitcase.

According to CBC, Tannous said he and his wife left the hotel in the morning before the luggage arrived without prior notice. He also said that the suitcase was destined to bring replacement purchases back home, but that the amount that CTA ordered Air Canada was not enough to cover the new luggage.

While the amount granted was sufficient to cover only the needs, Tannous also said that, at that time, an Air Canada employee informed them that they could spend “a reasonable amount” to replace the missing items.

“They couldn’t even track the luggage, if it is in Toronto or, like, on the way,” Tannous said. “It was under impression, the luggage is gone.”

According to Air Canada guidelinesThe airline promises that it will reimburse travelers “for reasonable expenses” for “rents or essential items”, such as clothing, dressing articles or rental equipment rentals, provided they are verified with receipts.

CBC reported that the maximum of the airline could disburse for lost or delayed luggage is an estimated $ 2,400. Air Canada, however, now states that Tannous did not properly justify purchases.

“I believed in the system, which is my mistake,” he said, describing the “unacceptable” situation. “It has to be changed.”
